Intellectual Property

Patent, trademark, and licensing issues are a regular part of our practice.

  • We provide ongoing consultation to the National Hockey League Players Association on a variety of intellectual property issues. We participate extensively in the NHLPA's licensing program and handle all litigation relating to those licenses. For example, we represented the NHLPA in a Lanham Act action filed in the Southern District of New York to preclude the unauthorized use of players' names on souvenir jerseys, which ultimately resulted in a favorable settlement for the players. We recently concluded an arbitration concerning the ownership rights to hockey jerseys that the players wear in NHL games and are currently handling a RICO class action filed against the NHLPA in a California federal court stemming from the NHLPA's trading card licensing program.

  • We represent Adams Apple Distributing L.P., a national distributor of novelty products, in numerous trademark and trade dress cases and have obtained preliminary and permanent injunctions protecting the company from counterfeiters.

  • Patent litigation is an important part of our practice. For example, we represented a major manufacturing company in patent litigation against two competitors who infringed our client's patents. After a six-week trial on the issue of infringement, the jury deliberated for just two hours before returning a verdict in our client's favor on every issue. We currently are representing Snap-on in a number of patent infringement cases.

  • We have represented Baker & Taylor, the nation's largest distributor of book, video and music, in a number of cases involving alleged copyright infringement.
